Terms and Conditions Terms and Conditions AGREEMENT BETWEEN YOU AND TENTH PLANET EVENTS LTD
When shopping with 10th Planet Events the following Terms & Conditions constitute a legal agreement between you and 10th Planet Events Limited. You must accept without modification all of the terms, conditions, and notices contained in these Terms & Conditions in order to access and use the online shopping service. If you do not accept these Terms & Conditions in their entirety, you may not access or use the services provided by Tenth Planet Events Limited. Please read or print a copy of these Terms & Conditions if you intend on shopping with us.
We reserve the right to change this agreement at any time without notice.
1. MODIFICATION OF THESE TERMS OF USE 1.1 Tenth Planet Events may wish to update or change the terms, conditions and notices for the service provided from time to time to reflect changes in the service, changes in the laws affecting the Services. 2. REFUNDS AND RETURNS 2.1 At Tenth Planet Events we want you to be happy with every purchase you make through our website store. Occasionally though, we know you may want to return an item, please find below our returns policy. This returns policy does not affect your statutory rights. 2.2 Our "no quibbles" guarantee means that if for any reason you are unhappy with your purchase, you can return it to us in its original condition, within 7 days. We accept the return of these items only if they are unopened and in their original condition. 2.3 If you return goods, as detailed above, within 7 days, we will issue a full refund for the price you paid for the item but not the postage costs. 2.4 If your item is faulty/damaged we will accept the return and also cover your postage costs but we must be notified within 48 hours of delivery of the fault/damage. 2.5 When returning your item you must return it with a returns form. One will be sent to you by post or email when you contact us. 2.6 Event Tickets are excluded from our 7 day Refund. Tickets are NON REFUNDABLE under any circumstances. You are booking for the event not one particular guest. Please also note all guests are advertised as 'Subject to Work Commitments'. Further information on Event Tickets please see SECTION 10. 3. POSTAGE COSTS REFUNDED 3.1 If the item is faulty we will cover your return postage. 3.2 If you are returning the item because you have changed your mind, any postage incurred is at the customer’s expense. 3.3 We recommend that you send the items back to us via a recorded delivery such as Special or Signed for as we can not be held responsible for any returned items that go missing through Royal Mail or any other service. 4. DATA PROTECTION & PRIVACY STATEMENT 4.1 Each party shall for the duration of any Agreement governed by these Terms and Conditions comply with the provisions of the Data Protection Act 1998, (including the data protection principles set out in that Act) and any similar or analogous laws, regulatory requirements or codes of practice governing the use, storage or transmission of personal data and shall not permit anything to be done which might cause or otherwise result in a breach by either party of the same. 4.2. At Tenth Planet Events we are committed to protecting your privacy. We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. 4.3 We will give you the chance to refuse any marketing email from 10th Planet Events. 4.4 The type of information we will collect about you includes: * your name * address * phone number * email address * credit/debit card details. This allows us to process and fulfil your orders and to notify you of the status of your order. 4.5 When you place orders with us on the internet we offer the use of a secure server. The secure server software (SSL) encrypts all information you input before it is sent to us. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998. Our security procedures mean that we may request proof of identity before we are able to disclose sensitive information to you. 4.6 The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy and the law and the Which? Web Trader Code. If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first. 4.7 We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings. If you have any questions/comments about privacy, please contact us by phone or email. 5. PAYMENT POLICY 5.1 Tenth Planet Events reserves the right to change prices or services at any time. 5.2 Payment by Credit or Debit Card will be processed by us and will appear on your Credit/Debit Card statement as Tenth Planet Events Ltd. 5.3 Payment via Cheque to 'Tenth Planet Events' please write your bank cheque guarantee card details on the reverse of the cheque before sending payment as this will delay your order while we contact you for the necessary information. If a cheque you send us is refused by your bank a £10 administration charge will be incurred. 5.4 PayPal is an authorised payment processor for Tenth Planet Events Limited. 5.5 Google Checkout is an authorised payment processor for Tenth Planet Events Limited. 5.6 If your order weight exceeds 2KG and is an overseas order we will contact you to confirm the actual postage costs. 6. TENTH PLANET EVENTS LTD’s RIGHT TO USE FEEDBACK OR SUGGESTIONS YOU SUBMIT 6.1 Tenth Planet Events wants your voluntary feedback and suggestions on the Services we provide so that we can continually improve the services for you and other customers. 6.2 You should understand that by submitting any feedback or suggestions to Tenth Planet Events concerning the Services we provide, you warrant and represent that you own or otherwise control the rights necessary to do so and you are granting Tenth Planet Events permission to: Use, modify, copy, distribute, transmit, publicly display, publicly perform, reproduce, publish, sublicense, create derivative works from, transfer, or sell any such feedback or suggestions. 7. UNDER THE CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS ACT WE WILL 7.1 Provide you with clear information about our products and services before you choose to purchase. 7.2 Be clear about our postage and packing costs and whether VAT or any other tax is included in the prices shown on our website upon checkout. 7.3 Provide a written confirmation of order following your purchase in the form of a confirmation email. 7.4 Allow a "cooling off" period where by you, the customer, can change your mind and cancel or return the order within 7 working days for most goods in their original packaging and unused. Certain exclusions do apply with items such as dedicated signature products and Event Tickets. 7.5 Allow you the right to cancel your order with no loss other than return postage and packing. 8. AVAILABILITY 8.1 All events, products and services are subject to availability and may be withdrawn at any time, including after you have placed your order. 8.2 If your order cannot be fulfilled we will let you know as soon as possible. 8.3 We reserve the right to withdraw any item from sale at any time, including after you have placed your order, due to our suppliers not being able to fulfil our orders. 8.4 We have products that are available for pre-ordering this means the item is not in stock but can be ordered online. These products all start with [Pre Order] before the title and will NOT be charged unless you pay via a payment gateway such as PayPal or Google until ready for dispatch. 9. EMAIL 9.1 Where possible please do not use Hotmail or Yahoo email accounts as the spam filters on these programs automaticlly delete our emails. 9.2 If you have no other email account please add our email to your 'safe senders list' to ensure you recieve emails from us. 10. ADDITIONAL CONVENTION AND EVENT TERMS AND CONDITIONS 10.1 Tenth Planet Events reserves the right to refuse admission. 10.2 Any person found behaving in an unlawful manner, causing a nuisance or disrupting the event will be ejected from the event without a refund. 10.3 Tickets are non refundable - refunds will only be considered under exceptional circumstances and are entirely at the discretion of the organizers and subject to an administration charge. 10.4 Tenth Planet accepts no responsibility for arrangements made by attendees with third parties. 10.5 Some guests may request a limit on the number of autographs signed, or we may have to limit sessions due to time or other constraints, therefore we cannot guarantee an autograph for every attendee. 10.6 All guests appear subject to work and personal commitments and they may only appear for 1 or part of 1 day during events. 10.7 Video recording of the event is NOT permitted at any of our events in the Main Hall or where ever there is Onstage Talks. 10.8 No attempt is made to supersede the rights to any of the copyright holders of the programs celebrated by Tenth Planet Events. 10.9 The ticket price does not include accommodation. 10.10 The weekend ticket price includes the Saturday Night Entertainment. 10.11 These are Unofficial Doctor Who Events and Conventions but this will not stop you from enjoying them! 11. PRE-ORDERS
We are pleased to accept pre-orders for certain Merchandise listed on this site. Please understand that we place our stock orders with manufacturers based on the Pre-Orders received from customers. These are firm orders that we cannot lower or cancel. Because of this, we must implement a re-stocking fee, at 20% of the Merchandise retail price for any cancelled orders. Please make sure you are aware of this before pre-ordering product. All scheduled release dates, prices, sizes and colours of items are based on information given to us by manufacturers, but should be considered tentative and are subject to change. Should any key details of the product change, we will endeavour to inform you as soon as possible.
Should the retail price of a Pre Order item increase once it becomes available, we will allow any Pre-Orders to be cancelled without applying the Re-Stocking charge. If a mixed order of In-stock and Pre-Order items is placed, the In-stock items will be shipped immediately, and the Pre-Order items will follow when available. Shipping costs will be allocated to each order as necessary. While we endeavour to have adequate stock made available to us by suppliers, we are on occasion allocated certain products. We allocate to customers on a first come, first served basis, so please get your Pre-Orders to us as soon as possible. We hope that all of the above is self explanatory, but please email or phone if you have any questions.
If electing to pay by cheque, please be aware that we will not begin to pull an order until the cheque arrives with us. There is always a possiblity that an item might go out of stock before your cheque arrives, so please send you cheque promptly.
On rare occasions guest signers may be unable to complete signing’s due to work or other commitments. If this happens you will be entitled to a full refund. If you have sent personal items to us we will use the postage paid to return these items. 12. RECORDING
Video recording of the event is NOT permitted at any of our events in the Main Hall or where ever there are Guest Talks. If you are found to be recording the event you will be ejected from the event without a refund. The event may be recorded on behalf of 10th Planet Events, by buying a package/ticket you give us your consent to use any material as a promotional tool, on the website, in a trailer or for a future DVD release. Furthermore you understand that you will not receive any financial compensation for the use of any material/recordings.
